    Terms of Service

    These Terms of Service ("Terms") govern your access to and use of the TaleHop website at https://talehop.com and all related services (collectively, the "Service") provided by TaleHop ("we," "us," or "our"). Please read these Terms carefully before using the Service. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

    1. Description of Service

    TaleHop is an AI-powered platform that enables users to create personalized children's storybooks. The Service uses artificial intelligence to generate story text and illustrations based on user-provided prompts and preferences. Users can preview, edit, and download their storybooks as print-ready PDF files.

    2. Eligibility

    You must be at least 18 years of age to create an account and use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is intended for use by adults (parents, caregivers, and educators) to create storybooks for children. Children should not use the Service directly.

    3. Account Registration

    To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.

    4. Credits and Payment

    4.1 Credit System

    The Service operates on a credit-based system. Certain actions, such as generating stories and creating storybooks, require credits. Credits can be purchased through the Service.

    4.2 Purchases

    All credit purchases are processed by Stripe, Inc. By making a purchase, you agree to Stripe's terms of service and privacy policy. You represent and warrant that you are authorized to use the payment method you provide.

    4.3 Refund Policy

    All credit purchases are final and non-refundable, except where required by applicable law. If you experience a technical issue that prevents you from using credits you have purchased, please contact us and we will review your case on an individual basis. We reserve the right to issue refunds or credit adjustments at our sole discretion.

    4.4 Pricing Changes

    We reserve the right to change our pricing at any time. Any price changes will apply to purchases made after the change takes effect. Previously purchased credits will not be affected by price changes.

    5. AI-Generated Content

    5.1 Nature of AI Content

    The Service uses third-party artificial intelligence models to generate story text and illustrations. AI-generated content is created algorithmically and may contain inaccuracies, errors, or content that does not match your expectations. We do not guarantee the accuracy, completeness, quality, or appropriateness of any AI-generated content.

    5.2 User Responsibility

    You are solely responsible for reviewing all AI-generated content before use, including before sharing it with children. You acknowledge that AI-generated content may occasionally produce unexpected or inappropriate results, and you agree to review all generated content for suitability.

    5.3 No Guarantee of Availability

    AI content generation depends on third-party providers. We do not guarantee uninterrupted availability of AI generation features. Service interruptions may occur due to third-party provider outages, maintenance, or changes to their services.

    6. Intellectual Property

    6.1 Our Intellectual Property

    The Service, including its design, features, functionality, code, documentation, logos, trademarks, and branding, is owned by TaleHop and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

    6.2 Your Content

    You retain ownership of the original prompts and text you provide to the Service. Subject to applicable law and the terms of our third-party AI providers, you are granted a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute the AI-generated storybooks created through your use of the Service for personal, non-commercial purposes, including printing and sharing with family and friends.

    6.3 Commercial Use

    Commercial use of AI-generated content (including but not limited to selling storybooks, using illustrations in commercial products, or publishing for profit) is not permitted without our prior written consent. Contact us if you wish to discuss commercial licensing.

    6.4 License to Us

    By submitting content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service. We will not use your content for marketing or promotional purposes without your explicit consent.

    7. Acceptable Use

    You agree not to use the Service to:

    • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
    • Generate content that sexualizes, exploits, or endangers children in any way
    • Generate content that promotes violence, discrimination, or hatred against any individual or group
    • Attempt to circumvent content safety filters or generate content that violates our AI providers' acceptable use policies
    • Use the Service for any purpose that violates applicable local, state, national, or international laws or regulations
    • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
    • Interfere with or disrupt the Service or the servers or networks connected to the Service
    • Attempt to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks connected to the Service
    • Use automated scripts, bots, or other means to access the Service or extract data without our express written permission
    • Resell, sublicense, or commercially distribute the Service or access to it without our prior written consent

    We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated these acceptable use provisions.

    8. Disclaimers

    THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

    WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR APPROPRIATENESS OF ANY AI-GENERATED CONTENT. AI-GENERATED STORIES AND ILLUSTRATIONS MAY CONTAIN ERRORS, INACCURACIES, OR CONTENT THAT IS NOT SUITABLE FOR ALL AUDIENCES. YOU USE THE SERVICE AND ANY AI-GENERATED CONTENT AT YOUR OWN RISK.

    9. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TALEHOP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

    10. Indemnification

    You agree to indemnify, defend, and hold harmless TaleHop and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit to the Service.

    11. Termination

    We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us. Upon account termination, we will delete your personal data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

    12. Governing Law and Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.

    13. Modifications to the Service

    We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. If we discontinue the Service entirely, we will make reasonable efforts to provide you with access to your generated content for a reasonable period.

    14. Changes to These Terms

    We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date" above. If the changes are significant, we will provide additional notice, such as an email notification. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service.

    15. Severability

    If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

    16. Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and TaleHop regarding the use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter hereof.
